Terms and Conditions
1. Seller and scope
These terms apply to orders placed in the Better Digital shop. The contracting party is Better Digital LLC at the contact details listed in the imprint. Different terms apply only if we confirm them in writing.
2. Products
The shop offers print-on-demand goods such as shirts, caps and stickers, as well as digital products, licenses or downloads. Physical products are usually produced only after the order is placed. Product images, colors, sizes, fabric weights, print positions and mockups are for orientation and may differ slightly from the delivered product.
Stock labels, editions and delivery windows are shop information. They are not guarantees unless explicitly stated as binding commitments.
3. Order and contract formation
Before submitting an order, customers can review and correct their order data. By clicking a clearly payment binding order button, the customer submits an offer to enter into a contract. We confirm receipt electronically. A contract is formed when we accept the order or start processing, production, provisioning or delivery.
4. Prices, payment and taxes
Prices are shown in CHF. Non-optional price components are included in the product or checkout price where technically and legally possible. Shipping costs, taxes, customs duties or import costs may vary by delivery country, cart and shipping method and may be shown at checkout or collected by the relevant authorities.
Payment is handled through the payment methods shown at checkout. Orders may be produced or provisioned only after successful authorization or payment.
5. Production, delivery and risk
Print-on-demand means production happens where it makes sense for the order, availability and delivery address. This is not a promise of production in Switzerland. Delivery windows are realistic estimates, not guaranteed dates. Partial or substitute deliveries may be used where reasonable for the customer.
6. Digital products and licenses
Digital products may be delivered as downloads, access, license keys, account activation or documentation, depending on the product. Unless stated otherwise, the customer receives a simple, non-transferable license. Resale, sharing, public distribution or use outside the product description is not permitted.
7. Returns, withdrawal and defects
Returns, withdrawal, cancellations and defects are described on the Returns page. Statutory rights for defective or wrongly delivered goods remain unaffected.
8. Fair use
The shop may not be used for fraudulent orders, payment circumvention, automated overload, infringement of third-party rights or unlawful purposes. We may reject or cancel orders where there is an objective reason, such as obvious pricing errors, abuse, sanctions risk or delivery obstacles.
9. Liability
To the extent permitted by law, we are not liable for missed preferred delivery dates, minor color or placement deviations, temporary technical interruptions or third-party services. Mandatory liability, including for intent, gross negligence, personal injury and statutory consumer rights, remains reserved.
10. Applicable law
Swiss law applies unless mandatory consumer rights provide otherwise. Mandatory jurisdictions and consumer protection rights remain reserved.
These terms are intentionally conservative. They do not limit rights customers have under mandatory law.
